Onshore Partner Visa Applications have more priority

Onshore partner visa applications are given more priority than offshore partner visa applications

The Department of Home Affairs has recently released Ministerial Direction 117 which provides instructions to delegates of the Minister to prioritise applicants for an onshore partner visa over applicants for an offshore partner visa. If you have an Australian partner and have been contemplating whether you should apply for the partner visa in Australia or outside Australia, the most beneficial approach would be to apply onshore.

A Partner visa is not a simple visa application, just because you and your partner are in a genuine committed relationship doesn’t mean the Department will believe you and grant you a Partner visa. The Department assesses all the evidence you provide to determine if you are in a genuine and committed relationship. Many clients tell us that they thought because they are married or have lived together for years, they can submit a partner visa application with minimal evidence and that it will be granted. This is just not true.

The evidence you submit for a partner visa must be specific, detailed and cover all aspects required by law including financial, social, household and the nature of your commitment. When you instruct us to act for you, we not only prepare your application and make detailed submissions, we also review every piece of evidence you provide to us and we will never submit anything unless we are satisfied that the evidence meets the criteria set out under Migration law.
